We recognize that HIPPA protects an individual’s health information. Is the Board or Management required to disclose any information about an owner that tested positive?

The board is not “required” to disclose any information once a resident tests positive for the coronavirus. In all cases to date, the resident has self reported to Management or the Board that they have tested positive. In those cases, it is appropriate to communicate with the community that a resident has tested positive and communicate the extra measures that the Association is taking to prevent the spread of the virus. It is also very important that the infected resident remain self quarantined per the guidelines of the CDC. The name of the infected resident should never be disclosed by board members or Management.
